My Spouse Won’t Give Me a Divorce
Question:
I’ve been married 23 years have 4 kids ages 23, 18, 17, 12. the last 2 still live at home. Bought a hose in June of 2015, its only in mine and my mothers name, not my wife’s. She cheated on me many times with many different men at least 10 or more, more than 12 years ago, but only admitted to 2. It still bothers me that she lives with these lies and I still have bad dreams about them. I wanted a divorce back then but she wouldn’t give me one, I left her several times and twice for other women but she still wouldn’t give me a divorce and it was real hard on my kids so I went back to her and tried to make the best of it. I went to catholic charities for counseling for a year and a half to help me deal with being in a marriage that I didn’t want to be in.

Answer:
Divorce is “no fault” in New York and has been since 2010. Although your wife has refused to consent to a divorce in the past, she has no ability to prevent a divorce now. Consult with a local attorney so you can determine all of your rights and obligations and make an informed decision on how best to proceed.
