New York Divorce Attorney Discusses Filing for Support Modifications
A wife moved from Pennsylvania to New York with the kids. When she files for a support modification will she have to include the Pennsylvania support information?
As an experienced New York Divorce Attorney, I can tell you that since the wife has registered the existing PA Order in New York State, and the payer parent now lives in New York State, New York now has jurisdiction over your support case should you chose to file a modification here. You should file a Petition for Modification of Support in the county where either you or your ex reside. It is perfectly acceptable for you to use the NYS Courts DIY forms, and to attach additional documentation to your petition. You should outline in your Petition what specific circumstances have changed (i.e. significantly increased income, and increased daycare expenses).
