As an experienced New York Divorce Attorney, I would recommend consulting with a local attorney to have the proper paperwork drafted to implement a plan like this. An attorney can draft a stipulation and then file a custody modification petition in Family Court. The stipulation can then be submitted to the Court with an Order which serves to “settle” the modification petition. In most instances, if the paperwork is properly prepared and submitted, a court appearance is not necessary.
