As an experienced New York Divorce Attorney, I know in New York, a child emancipates at age 21 for child support purposes. However, there are also other events which trigger termination of child support for that child. For example, when a child is over 18 and employed full-time (e.g. self-supporting) he/she may be deemed emancipated. You should consult with an attorney about modifying the child support obligation for that child as well as to review the Agreement relative to the 21-year-old to ensure you are not unnecessarily paying support for him/her.
