- Uncontested divorces where only one spouse resides in New York can be completed if there are children of the marriage who reside elsewhere.
- If the children have lived in another state for more than six months, New York State no longer has jurisdiction regarding their custody, so any divorce agreement will not address the issue of custody.
- The parties cannot simply direct the New York court to assume jurisdiction regarding the custody issue if the child resides outside of New York and has done so for the past six months.
