- While a residency requirement must be met in order to obtain a judgment of divorce, the filing party need not be a current resident of New York.
- If the marriage took place in New York, the residency requirement is satisfied if one spouse has resided here for at least one continuous year prior to the divorce.
- If one spouse has resided here for a continuous period of two years prior to the divorce – irrespective of where the marriage occurred – the residency requirement is met.
