New York Legal Separation Agreement

Definition, Requirements, Pricing, and Quick Start Options Below

The separation agreement option is for clients who do not wish to be divorced now. They simply wish to be legally separated. There are number of reasons why clients do not wish to move to a divorce. The most common is to maintain a family life or health insurance policy. When you select this option, the New York Divorce Attorneys at our office will walk you through all the issues that need to be determined before separation agreement can be finalized. Those issues include the division of assets and debts, spousal maintenance, custody of children, and child support.

The cost for this option is $595 if you have children and $545 if you do not have children. There are no disbursement or filing fees for this option so the legal fee is the only fee that you will pay.

 How do you get started?

You start by filling out the basic information below. You will then be taken to our payment page.  Once you pay your fee, our office will then contact you to obtain all the information we need from you to move through this process. If you have questions about any of the issues or if you’re not sure if this is the right option for you, call our office or select the education series. Requirements: You and your spouse would like to be legally separated and you do not have a formal written New York State Separation or Settlement Agreement.

A Separation or Settlement Agreement outlines all of your family issues, including the division of property, child custody, child support, and spousal support.

This option applies to you if you want to be legally separated but you do not have a written Separation or Settlement Agreement. You and your spouse must have discussed and agreed upon the terms that you will include in your Separation Agreement.

Only one spouse can retain our firm. The spouse retaining our office will complete our online forms.

Our New York Divorce Lawyers will prepare a formal written Separation or Settlement Agreement that complies with New York law. We will not prepare the papers necessary to finalize your Divorce. One year after you and your spouse sign your Separation Agreement, you may retain our firm to obtain a Conversion Divorce.

This option does not include any negotiation, by our office attorneys to finalize your Agreement, with your spouse or your spouse’s attorney.
